If you are or suspect you may be one of the thousands of Australians affected by asbestos, mesothelioma or another dust disease, then you may be entitled to compensation.

Exposure to asbestos has been linked to a host of serious illnesses, including:

  • Asbestosis;
  • Mesothelioma;
  • Pleural plaques;
  • Lung cancer;
  • Oesophageal cancer;
  • Larynx cancer;
  • Other serious illnesses and conditions.

Because these dust diseases can take years to develop, you may be eligible to make a claim regardless of when you were exposed. Different states and territories have different time limits for making a claim, and it is always best to seek advice as early as possible after your diagnosis.

You may be at increased risk of contracting a dust disease if you work or have worked in:

  • Construction;
  • Manufacturing;
  • Mining;
  • Firefighting;
  • Excavation;
  • Gardening and landscaping.

You may also have been exposed to harmful dust outside of your job, for example:

  • Living close to an industrial site;
  • Renovating a home containing asbestos;
  • Living with someone who has worked with asbestos.

In certain circumstances, you may be eligible to make a claim for compensation if your dust disease was not work-related.

If a loved one has tragically died from an asbestos disease, you may be able to claim death benefits.

As with all compensation, the types of claims you are entitled to will depend on your personal circumstances, so it is best to speak to one of the experienced solicitors at Lionheart Lawyers to understand your rights.

Making a Negligence Claim for Asbestos Related Injuries

If your dust disease was caused by employer negligence, you may be able to make a lump sum claim against your employer, the premises where your exposure occurred, or the manufacturer of the asbestos products.

If your asbestos exposure occurred outside of work, then you may be able to claim against the manufacturer of the asbestos products.

You may be able to claim for:

  • Medical and treatment expenses;
  • Out-of-pocket expenses incurred and ongoing costs;
  • Pain and suffering;
  • Loss of income (past and future);
  • Domestic care and assistance.

In NSW, these claims are made in the Dust Diseases Tribunal, a specialist court dedicated to dust disease cases.

Claiming for Mesothelioma Sustained at Work

Mesothelioma is a cancer caused by exposure to asbestos dust. This form of cancer tends to emerge many years after asbestos exposure – often 35-40 years later, although every individual will have a different experience.

Unfortunately, no recognised treatment exists that offers a cure for mesothelioma.

If you have contracted mesothelioma from exposure to asbestos at work in NSW, then you are entitled to make a claim through both:

  1. The Dust Diseases Tribunal (DDT); and
  2. The Dust Diseases Authority (DDA).

Workers who have contracted mesothelioma are entitled to compensation from the Dust Diseases Authority of NSW. This can include: regular payments, treatment expenses and domestic assistance. The amount you are entitled to will vary depending on your level of impairment.

Additionally, you may be entitled to make a common law claim through the Dust Diseases Tribunal. Mesothelioma cases will often settle at mediation before the need to commence court proceedings. The DDT was set up to promote the prompt completion of dust disease compensation cases, ideally within the victim’s lifetime. If your matter is urgent, then the DDT will process it on an urgent basis.

Lionheart Lawyers will lodge your mesothelioma claims with the DDT and DDA on your behalf. We will manage the process from start to finish to make sure you receive maximum compensation for your dust disease. We understand that no amount of money can fix your mesothelioma, but compensation can provide vital assistance and care for you and provide for your family’s future.
