Financial Separation Agreements

If you and your former partner reach a mutual agreement about your finances and property, you can formalise these arrangements by entering into a Financial Agreement. This is a contract between two or more parties (married or de facto) and is made under the Family Law Act 1975. This type of arrangement, if executed correctly, can be a way for you to avoid court proceedings. 

Parties may enter Financial Agreements before the marriage or commencement of the de facto relationship or after. Financial Agreements can be a very useful and cost-effective way of resolving Family Law property disputes and can contain a range of terms to ensure a desirable outcome for each party.

Family Financial Settlements

Most parties within a marriage or de facto relationship will accumulate assets during the relationship. Such assets may include:

  • Money – investments, liquid cash and savings

  • Personal items such as jewellery, cars, boats, art work

  • Household contents
  • Loans owing from family members or third parties.

These assets of the relationship are typically associated or connected with debts including mortgages, credit cards, related and unrelated party loans.

We will then assist you in complying with the pre-action procedures, including preparing your full and frank financial disclosure material and reviewing your ex-partner’s material. If your ex-partner is not willing to share their material, we will take the necessary steps to obtain that material on your behalf. Once we understand the true value of net assets, we will seek to resolve the matter informally by participating in pre-Court settlement discussions. If those discussions are unsuccessful, we will take your instruction to commence Court proceedings on your behalf and continue to seek to resolve your matter in your best interests. Unfortunately, sometimes matters do not resolve, particularly if one party has chosen to hide assets or refuses to agree to split the assets in a fair and just manner. In these situations, we are ready to put your best case forward before the Court to ensure you achieve the outcome you deserve. 

When finalising your matter by settlement, we will prepare the terms of the Consent Orders or Financial Agreement and be there to ensure you receive your share of the financial settlement. 

In the instance that your financial settlement is not complied with, we are ready to assist you in taking enforcement action.
