When you separate from your partner (whether it is from a marriage or a de facto relationship), you will need to resolve how to divide the assets and debts between the two of you. This may involve a division of real property, cash, superannuation, shares, interests in businesses or trusts. You may also require assistance with recovering loans or money transferred by your ex-partner during the relationship. Depending on the situation, you may need financial support from your ex-partner, either in the form of spousal or de facto maintenance, or, if you have children, child support.

If it is possible to do so, Lionheart Lawyers will assist you and your ex-partner to reach an agreement about all matters concerning property and parenting (if applicable), saving you time and money.

If you and your ex-partner cannot agree on an outcome, then we will vigorously represent your best interests in pursuing your family law rights. Call us today for an obligation-free consultation with one of our expert family law lawyers. We will advise the best course of action for you to take to ensure your rights are protected and for you to achieve an outcome that you deserve.

Legal Advice for Family Financial Disputes

At Lionheart Lawyers, we have over 50 years of combined experience helping our clients in family financial disputes. We understand that these matters can feel overwhelming and our priority is making sure our client’s rights are protected and they obtain the best possible outcome under the law.

Our advice will be tailored to your circumstances and we will guide you through the process from start to finish. We will assist you with understanding the financial situation (including working through the full and frank financial disclosure obligations and material of all parties), participating in conciliation and mediation, and appearing on your behalf in Court proceedings (if required).

Our expert lawyers possess intimate knowledge of the vast array of financial arrangements and different asset and liability structures. We are adept at working out the true value of the assets of the parties, liabilities and any money taken out of the relationship for the benefit of one of the parties. If children are involved, we will always guide you to make decisions in the best interests of the children and we will help you obtain a parenting outcome most suitable to your circumstances.

Limitation periods (time limits for applying to the Court) apply to most financial proceedings. Please contact our expert family lawyers today for an initial free discussion about your circumstances.

Financial Separation Agreements

If you and your former partner reach a mutual agreement about your finances and property, you can formalise these arrangements by entering into a Financial Agreement. This is a contract between two or more parties (married or de facto) and is made under the Family Law Act 1975. This type of arrangement, if executed correctly, can be a way for you to avoid court proceedings.

Parties may enter Financial Agreements before the marriage or commencement of the de facto relationship or after. Financial Agreements can be a very useful and cost-effective way of resolving Family Law property disputes and can contain a range of terms to ensure a desirable outcome for each party.

Financial Agreements are subject to strict requirements under the Family Law Act. To minimise the risk of a Financial Agreement being challenged or set aside by a Court at a later date, contact Lionheart Lawyers for an initial free telephone discussion with one of our expert family lawyers.

Family Financial Settlements

Most parties within a marriage or de facto relationship will accumulate assets during the relationship. Such assets may include:

  • Money – investments, liquid cash and savings
  • Business interests
  • Shares
  • Personal items such as jewellery, cars, boats, art work
  • Residential and commercial property
  • Household contents
  • Loans owing from family members or third parties.

These assets of the relationship are typically associated or connected with debts including mortgages, credit cards, related and unrelated party loans.

The expert family lawyers at Lionheart Lawyers specialise in understanding the net asset position of all parties. We will prepare a balance sheet with a view to advising you of your rights and entitlements and reaching an outcome in which you receive your fair share of the asset pool.

We understand exactly how complicated finances can be. We will work with you to determine the true value of the assets of the relationship and help you recover any assets or monies transferred out by another party during your relationship.

We will start by listening to you carefully to understand your circumstances. We will then assist you in complying with the pre-action procedures, including preparing your full and frank financial disclosure material and reviewing your ex-partner’s material. If your ex-partner is not willing to share their material, we will take the necessary steps to obtain that material on your behalf. Once we understand the true value of net assets, we will seek to resolve the matter informally by participating in pre-Court settlement discussions. If those discussions are unsuccessful, we will take your instruction to commence Court proceedings on your behalf and continue to seek to resolve your matter in your best interests. Unfortunately, sometimes matters do not resolve, particularly if one party has chosen to hide assets or refuses to agree to split the assets in a fair and just manner. In these situations, we are ready to put your best case forward before the Court to ensure you achieve the outcome you deserve.

When finalising your matter by settlement, we will prepare the terms of the Consent Orders or Financial Agreement and be there to ensure you receive your share of the financial settlement.

In the instance that your financial settlement is not complied with, we are ready to assist you in taking enforcement action.
