We will help you to file for divorce and guide you through every step required. We can also help you sort out your property and financial settlements to ensure that everything is split fairly and that you and your family are taken care of now and into the future.

If you have children, we will help you to arrange parenting agreements that ensure that the welfare of the children is always first and foremost.

Property & Financial Settlements

We understand the many complexities of property and financial settlements arising from a divorce or separation. We will help you make optimal arrangements to protect your financial future.

Often, property settlements can involve more than just your family home. They may include your business, personal property, any shareholdings and even your superannuation or your partner’s superannuation.

We have extensive experience in all of these areas and are equipped to settle all potential property disputes stemming from your divorce or separation.

Filing for Divorce

You are able to file for divorce once your relationship has irrevocably broken down and you have been separated for a minimum of 12 months and 1 day or longer.

Once you are eligible to file for divorce, we can help you complete the necessary paperwork and file your divorce application with the Federal Circuit and Family Court of Australia.

It might take up to 2 months for the Court to hear your case. A registrar of the Court will attend the hearing and ascertain whether all the requirements are met and then grant you the divorce order.

Parenting Agreements After Divorce

While divorce and separation are always difficult, it can become even more complex when there are children involved. In this situation, it may be necessary to make parenting agreements that support the best interests of your children.

Some parties are able to come to agreement on the best parenting arrangements for their children, while others may face disputes that will have to go before the Court.

If you are required to attend Court, our experienced and compassionate family law professionals will be by your side through the entire process.

If you feel that disputes may arise in relation to the care of your children, reach out to us straight away.

De Facto Relationship Asset Protection

If your de facto relationship breaks down and you have assets such as a family home, we can assist you with resolving any dispute about those assets.

Under the Family Law Act 1975, people involved in de facto relationships have the same rights as married couples. If your de facto relationship breaks down, call Lionheart Lawyers so we can assist you with all aspects of your separation, including parenting arrangements and financial settlements.
