Domestic and family violence is any type of behaviour that coerces, controls or causes a family member to be afraid. Domestic and family violence can have a traumatic and devastating impact on spouses and children. Importantly, not all family violence includes physical violence. It can take many forms, such as sexual violence and coercion, emotional abuse, financial abuse, spiritual abuse or cultural abuse.

In matters of family violence, Lionheart Lawyers act on behalf of victims, applying for legal protections and court orders to protect against further risks of domestic or family violence. This can also include seeking appropriate parenting and/or property orders from the Federal Circuit and Family Court of Australia.

Legal Advice for Victims of Family Violence

Family and domestic violence is described in Section 4AB of the Family Law Act 1975 as an act of violence, threatening or similar negative behaviour by a person who is trying to control a family member and thus, causes the family member to be fearful.

If family violence is perpetuated in a relationship and the parties involved are going through a separation, we can assist the victim in particular to apply for restraints or injunctions to protect them from further acts of violence or intimidation. This can include applications and amendments of parenting orders and/or property orders on behalf of the victim.

Parenting and Property Orders Resulting from Family Violence

If you are a victim of family violence, you can apply for certain parenting and/or property orders to protect yourself and children from further harm. These orders can be obtained from the Federal Circuit and Family Court of Australia.

Seeking property adjustment orders in favour of a party to a marriage who has experienced a course of violent conduct making their contributions to the marriage significantly more difficult than they ought to have been;
Seeking a greater share of the marital asset pool so that you and your children are not unduly disadvantaged financially due to the family violence that has occurred.
