Legal Advice for Asbestos Compensation Claims

A medical assessment to determine your disease;
Work history;
Records of your income and life before and after contracting your disease;

4. We will lodge your asbestos disease claim with the relevant insurer and manage the entire process through to settlement;

5. If the insurer does not offer a reasonable settlement, then we will advise you of next steps, including commencing court proceedings.

Making a Negligence Claim for Asbestos Related Injuries

If your dust disease was caused by employer negligence, you may be able to make a lump sum claim against your employer, the premises where your exposure occurred, or the manufacturer of the asbestos products.

If your asbestos exposure occurred outside of work, then you may be able to claim against the manufacturer of the asbestos products.

You may be able to claim for:

Loss of income (past and future);
Domestic care and assistance.

In NSW, these claims are made in the Dust Diseases Tribunal, a specialist court dedicated to dust disease cases.

Claiming for Mesothelioma Sustained at Work

Mesothelioma is a cancer caused by exposure to asbestos dust. This form of cancer tends to emerge many years after asbestos exposure – often 35-40 years later, although every individual will have a different experience.

Unfortunately, no recognised treatment exists that offers a cure for mesothelioma.

If you have contracted mesothelioma from exposure to asbestos at work in NSW, then you are entitled to make a claim through both:

The Dust Diseases Tribunal (DDT); and
The Dust Diseases Authority (DDA).

Workers who have contracted mesothelioma are entitled to compensation from the Dust Diseases Authority of NSW. This can include: regular payments, treatment expenses and domestic assistance. The amount you are entitled to will vary depending on your level of impairment.

Additionally, you may be entitled to make a common law claim through the Dust Diseases Tribunal. Mesothelioma cases will often settle at mediation before the need to commence court proceedings. The DDT was set up to promote the prompt completion of dust disease compensation cases, ideally within the victim’s lifetime. If your matter is urgent, then the DDT will process it on an urgent basis.
